1. General provisions

1.1 These General Terms and Conditions (hereinafter referred to as GTC’s) of the Online Shop Olio Puro, Sapori Bellavista SA, Stadelhoferstrasse 42, 8001 Zürich, hereinafter referred to as Olio Puro Shop, regulate the rights and obligations of users (hereinafter referred to as Buyer/Customer) of the website of Olio Puro Shop on https://www.oliopuro.ch in connection with the use of the services offered (use of the website, sale of goods, etc.).

They regulate the legal relations between Olio Puro Shop and the buyers / customers conclusively, unless they refer to other provisions or declare them applicable.

1.2 Olio Puro Shop reserves the right to change these terms and conditions at any time and without giving reasons and to publish the latest version on https://www.oliopuro.ch. By clicking the button “Buy now” you place a binding order of the goods contained in the shopping cart. The confirmation of receipt of the order follows immediately after sending the order.

2. Validity of the GTC

2.1 These General Terms and Conditions apply to sales contracts concluded by both private individuals and companies through the Olio Puro Shop website.

2.2 For distance purchases concluded by other means, e.g. by e-mail, telephone or letter, these General Terms and Conditions shall also apply.

2.3 These General Terms and Conditions can be viewed, downloaded, saved and printed at any time at https://www.oliopuro.ch under GTC.

3. Conclusion of contract

3.1 Olio Puro Shop (seller, provider) sells goods and products according to the online offer list of goods and thus becomes a contracting party of the buyer / customer with respect to the purchased items upon conclusion of the purchase contract.

3.2 Offers in the online store are considered invitations to submit an offer. With the order by clicking the button “Buy now” the buyer / customer then bindingly declares the conclusion of the contract with and thus the acceptance of these terms and conditions. The order will subsequently be confirmed by Barfüsser Shop by e-mail.

3.3 However, Olio Puro Shop shall not be liable for the failure/loss of confirmations sent by e-mail or in the event of incorrect e-mail information provided by the buyer/customer. Consequently, it remains at liberty to prove the conclusion by showing a confirmation email.

4. Content of the contract

4.1 Subject to the present GTC’s, the content of the contract concluded between and the buyer/customer is determined by the product description listed by it and the conditions specified by it according to the list of goods offered, as they were apparent at the time of the binding order on the part of the buyer/customer on the order page.

5. Duty of care of the customer

5.1 The customer undertakes to provide true, accurate, current and complete information about himself on the order form. Olio Puro Shop excludes any liability for loss and damage resulting from failure to comply with these obligations. Olio Puro Shop reserves the right to verify this information by calling back or similar appropriate measures and to exclude individuals from the online ordering service in case of non-compliance with our Terms and Conditions.

6. Prices and offers

6.1 Prices are quoted in Swiss francs (CHF) and include the statutory value added tax.

6.2 Olio Puro Shop reserves the right to change prices at any time. For the buyers/customers, the prices published on the website on the order date apply.

6.3 Offers on are subject to the (resolutive) condition of an incorrect price quote or an impossibility of delivery. Olio Puro Shop is not liable for obviously incorrect price quotes or product descriptions.

6.4 Olio PuroShop reserves the right to modify, interrupt or discontinue the service offered, temporarily or permanently, with or without notice to the customer. Olio Puro Shop is not liable to the customer for the modification, interruption or discontinuation of the service.

7. Payment and delivery

8. Privacy

The personal data will be treated confidentially by according to the data protection legislation.

9. Warranty and liability

9.1 The customer expressly agrees that the use of the service provided by Olio Puro Shop is at your own risk. A liability of for direct damage is as far as legally permissible, expressly wegbedungen. Liability for slight negligence is therefore excluded. Likewise, neither for indirect damages nor for consequential damages is liable.

9.2 Olio Puro Shop shall not be liable for any temporary unavailability of the Website, nor for the failure of any or all Website functions or malfunctions of the Website, nor for the use of the Website in general.

9.3 The buyer/customer is responsible for the security of the systems, programs and data within his sphere of influence. In his own interest, the buyer/customer should keep passwords and user names secret from third parties.

9.4 Olio Puro Shop is not liable for defects and malfunctions for which they are not responsible, in particular for security defects and operational failures of third-party companies with which they collaborated or on which they depend.

9.5 Furthermore, no liability is accepted for force majeure, improper action and disregard of risks on the part of the buyer/customer or third parties, excessive use, unsuitable operating materials, extreme environmental influences, intervention by the customer or interference by third parties (viruses, etc.), which may occur despite safety precautions.

10. Severability clause, applicable law and place of jurisdiction

10.1 Should individual provisions of these General Terms and Conditions be void or ineffective in whole or in part, the validity or effectiveness of the remaining (partial) provisions shall not be affected thereby. Invalid or ineffective provisions shall be replaced by provisions that come as close as possible to the economic sense and purpose of the invalid or ineffective provisions. The same shall apply in the event of any loopholes in these provisions.

10.2 These GTC’s, the sales contracts concluded between buyer/customer and as well as all disputes in connection therewith are exclusively subject to Swiss law.

10.3 Exclusive jurisdiction for all disputes arising from the business relationship between the buyer / customer and, any legally binding jurisdiction reserved, is the seat of Olio Puro Shop.
